Pharmacy Law Waivers Soon Expiring (Business & Professions Code §4062)

In a continuing effort to keep our current and prospective clients up to date with important changes and happenings in the area of California Pharmacy Law, we at Brown & Brown would like to make you aware of this breaking news from the California Board of Pharmacy:

The Board just announced a reminder that the following limited waivers issued pursuant to California Business and Professions Code §4062 will expire August 31, 2021:

  1. Prescriber Dispensing Medication to Emergency Room Patient (B&P §§4068(a)(1), 4062(a)(5) and 4068(a)(6): Expiration of this waiver is August 31, 2021, or 30 days after  the governor’s emergency declaration is lifted, whichever is sooner.
  2. Signature Requirement for Receipt of Delivery of Drugs (B&P §4059.5): Expiration of this waiver is August 31, 2021, or 30 days after the governor’s emergency declaration is lifted, whichever is sooner.

Though these waivers are soon expiring, an individual or entity may request that the Board issue a site-specific waiver.
