Brown & Brown Secures Mental Health Diversion In Serious Felony Hit and Run Case

Adam B. Brown, Attorney at Law, recently obtained an excellent result for our criminal client facing a felony hit and run case in the Los Angeles area, which will likely result in a dismissal of the case in the near future.

The client was charged with felony hit and run after hitting a motorcyclist with severe injuries, including the amputation of a leg.  Mr. Brown successfully requested that the court place the client on “Mental Health Diversion,” pursuant to California Penal Code 1001.36 and filed a winning written motion which the court granted. 

This result means that the client will have to participate in mental health therapy on a consistent basis, obey all laws and court orders and the felony hit and run will ultimately be dismissed after a period of time, assuming full compliance with the Mental Health Diversion program and community service requirements.  

Mr. Brown was also able to keep the client from paying any restitution, or repayment for the other party’s injuries, other than what her insurance carrier paid out—this resulted in savings to the client of hundreds of thousands, if not millions, of dollars.

The prosecution’s best offer was two years prison, so Mr. Brown’s perseverance and written briefing skills made the difference between this client facing serious prison time and having this case dismissed entirely.

While this case was a very difficult and tragic one, the client had no criminal history and was extremely remorseful—Mr. Brown’s legal writing and oral argument abilities changed her life permanently, and for the better.
